The regular semi-monthly meeting of the Board of Trustees of the Village of Menands, held on Monday, June 1st, 2020 was called to order by Mayor Megan Grenier at 6:00 P.M. via Google Hangout Meets, due to the COVID-19 pandemic.

At 6 PM on Monday June 1st, 2020 Mayor Meg Grenier read the following statement: this is the Village of Menands Board of Trustees, semi-monthly meeting. I am Mayor Meg Grenier and as it is 6 o’clock, I will call this meeting to order. For anyone outside the village staff who is attending this video conference, I would ask if you would please identify yourselves; Ethan Gaddy, Chazen, Eric Johnson, Chazen, Tim O’Bryen, Chris Diaz, Verizon, present, Bill Nevins, present, Susan and Mike MacKay, present, Renee Leguire, present, stated they were present. The Mayor asked them to mute their microphones.

Mayor Grenier then did a roll call of Village staff; Deputy Mayor Aileen Nicoll, present, Trustee Seth Harris, present, Trustee Brian Marsh, present, Clerk Don Handerhan, present, Treasurer Bill Smith, present, Village Attorney Steve Rehfuss, present. On behalf of the Village Board I would ask all residents that we please keep our First Responders, all essential workers and those affected by this pandemic in our thoughts and prayers.

Pursuant to Governor Cuomo’s executive order number 202.1 issued on March 13th, 2020: Suspending article 7 of the public officers law, to the extent necessary to permit any Public body to meet, and take such actions authorized by law that allowed the public to not be physically present at the meeting, but allow the public to listen to or view such meetings via teleconference call or video conference, while recording and later transcribing of the meeting. Village of Menands Board of Trustees semi-monthly meeting is being held via Google Meets video conference to protect Public Safety and Welfare during this COVID-19 pandemic. In an effort to conduct this meeting effectively we asked those in attendance to please mute your microphone during the meeting. As we are conducting only essential business during tonight’s meeting, there will be no public comment. Any comments previously submitted to Clerk Handerhan prior to the meeting and deemed essential will be read into the record.

Public Hearing

Mayor Grenier read Conditions:

The applicant shall provide documentation to the satisfaction of the Village Board which identifies that the project has proper financing in place prior to the Village Board issuing final site plan approval.
Should the Village Board grant final site plan approval and a building permit is issued, the duration from building permit issuance to completion of construction and certificate of occupancy issuance shall be no longer than 18-months.
The Village Board reserves the right to request a traffic impact study from the application during the site plan review process.
During the site plan review process, the applicant shall submit certain design details, including but not limited to, building form and facades, for the Village’s review and approval. The Village reserves the right to require specific design of the building form and facades.
That the Special Use Permit is issued to the applicant only and is transferable only upon application and approval of the Village Board of Trustees.

A motion was made by Trustee Marsh to accept the minutes for the May 18th, 2020 Board Meeting, seconded by Trustee Harris.

Chris Diaz from Verizon lead discussion regarding installing a GPS system in DPW, Fire Department and other Police vehicles. How the system works and the benefits. Discussion Followed.

A motion was made by Trustee Harris to approve purchase of GPS from Verizon at a cost of $246.75 per month plus $453.45 onetime charge for GPS units, seconded by Trustee Marsh.

Ethan Gaddy from Chazen, lead discussion and answered questions regarding 35 Broadway Special Use Permit and set a date of June 15th, 2020 at 6 PM for Public Hearing. A Google Drive file has been setup for all parties involved with all documents in the file.

Ethan Gaddy from Chazen, lead discussion and answered questions regarding recommendations of the Albany County Planning Board, about the Comprehensive Plan that was submitted to them. Ethan Gaddy advised the Board that the final step of Comprehensive Plan has been completed with the approval by the Albany County Planning Board. The Comprehensive is now ready for the Village Board to adopt. Discussion followed.

Trustee Marsh read the following resolution approve and adopt the Comprehensive Plan;

Village of Menands Comprehensive Plan

Action: Adoption of a Comprehensive Plan and Review of Albany County Planning Board Advisory Comments

WHEREAS, the Village Board of the Village of Menands completed the SEQR process and conditionally adopted the Village Comprehensive Plan on May 4, 2020; and

WHEREAS, the Albany County Planning Board is required to review the Village Comprehensive Plan pursuant to the applicable standards of New York State General Municipal Law 239-m and this review is considered an advisory option under SEQRA; and,

WHEREAS, the Village has received an advisory opinion from the Albany County Planning Board (ACPB) dated May 21, 2020 indicating that the ACPB supports the Village’s adoption of the Comprehensive Plan and has also provided advisory comments; and

WHEREAS, the Village Board has considered the advisory comments from the ACPB, and

NOW THEREFORE, BE IT RESOLVED:

THAT THE Village Board of the Village of Menands hereby determines that the Comprehensive Plan and all its Appendices dated May 4, 2020, attached hereto and made a part hereof, is hereby officially adopted as the Comprehensive Plan of the Village of Menands; and

THAT THE Village Board shall file a final copy of the Village of Menands Comprehensive Plan with the Village Clerk and with the Albany County Planning Department as required in law 7-722; and

THAT THE Village Board shall post a final copy of the adopted Comprehensive Plan including all its Appendices to be accessible on the Village website; and

THAT THE Village Board authorizes the Village Clerk to circulate copies of the Comprehensive Plan to all adjacent municipalities;

Eric Johnson from Chazen, lead discussion regarding revisions to current subdivision regulations. Eric read a version of the subdivision regulation for the board to consider, discussion followed.

Trustee Nicoll introduced Local Law #3 A173 Subdivision Regulations and set June 15th, 2020 for a Public Hearing, seconded by Trustee Marsh.

The Clerk advised the Board, the need to repair the air handler at the Wards Pump Station. The Clerk received quotes from Dwight and from Mr. Comfort (the company that installed the unit.)

A motion was made by Trustee Marsh to approve to repair the Wards Pump Station Air Handler at cost of $3,750.00 by Dwight, seconded by Trustee Harris.

There are 2 grinder pumps at 21 A & B Louis Ave that need to be replaced. GL Laplant has given a quote for $22,556.00 to replace both grinder pumps. Discussion followed. After the discussion the grinder pumps were tabled until next meeting, so the Clerk would be able to get additional quotes and to have the Village Attorney go over the contract.

On the May 18th meeting the Board approved to KPI inspect sewer lines in the south end of the village. During the meeting the cost to inspect the sewer lines was incorrect.
Trustee Nicoll made a motion to correct the price for KPI to complete the inspections sewer lines in the south end of the village to $12,000.00, seconded by Harris.

Treasurer Smith gave an update of the fiscal status of the village and plans he has in place to deal with lower revenue.

Chief Frank Lacosse updated the Board regard assisting the City of Albany, Town of Guilderland and Town of Colonie this past weekend due to the riots. Chief Lacosse advised the Board that there is a need to purchase riot gear for his officers. The items he would need to purchase are gas masks, face shields, batons and riot shields. The cost would be approximately $10,000.00.

A motion was made by Trustee Marsh to authorize Chief Lacosse to purchase riot gear up to cost of $10,000.00, seconded by Trustee Nicoll.

The Board thanked the Police Department for their action helping surround communities.

Ethan Gaddy gave the Board an update regarding CDTA bus rapid system. Ethan met with CDTA Planning and would like to make a presentation at next meeting.

Trustee Harris asked if there was any consideration to proposal for an unpaid internship this summer. Discussion followed. After the discussion Mayor Grenier asked Trustee Harris to oversee the project.

Trustee Harris thanked Mayor Grenier for the efficient way she has been running the meeting during this time.

Mayor Grenier read the following from Bill Garvey’s submitted a letter to express his topics of concern:

I like to thank our DPW crew for removal of 2 dead grey squirrels from northside of Menand Road in area between Menand Road and Cornell Drive. GOOD JOB.

I like to thank DOT crew for recently removing bush and weeds from 1 red fire hydrant on west side Broadway which is behind metal street light marker No. 64. GOOD JOB.

I wish to give special thanks to all essential and frontline workers in Menands and ALL local communities throughout our nation for their time, effort, devotion, skill, bravery, energy and courage in helping to save and preserve human lives during this Corona Virus Pandemic Crisis. GOOD JOB.

If and when the Menands Village Board does decide to adopt my proposal for red, yellow, orange, light purple, white and light green trail markers as part of trail projects, when will the Village Board adopt my proposal? Plus, how man colored trail markers are going to be posted on those trails?
