The regular semi-monthly meeting of the Board of Trustees of the Village of Menands, held on Monday, March 21st, 2016 was called to order by Mayor Megan Grenier at 6:00 P.M.

Also attending:  Brian Marsh, Paul Cooney, John Stangle, Lyle Darmetko, and Rick Rogozinski.

The Mayor led the Pledge of Allegiance.

Open Forum:

Resident Brian Marsh asked if the Village would still be conducting the water test tomorrow.  The Clerk responded.

He also asked when it would be appropriate to ask questions in regards to the budget.  The Mayor responded.

A motion was made by Trustee Nicoll, seconded by Trustee Foley to accept the minutes of the March 7th, 2016 Board Meeting as amended.

A motion was made by Trustee Nicoll, seconded by Trustee Harris to approve payment for the following:

Mayor Grenier presented her Tentative Village Budget for 2016 – 2017 to the Board.  A motion was made by Trustee Harris, seconded by Trustee Boulet to set a Public Hearing on the Budget for Monday, April 11th, 2016 at 5:30 P.M. at the Village Hall.

Trustee Nicoll introduced the following proposed Local Law # 1 for 2016, seconded by Trustee Boulet.

LOCAL LAW NO. 1 OF THE YEAR 2016

Village of Menands, County of Albany

A local law authorizing a property tax levy in excess of the limit established in General Municipal Law §3-c.

Section 1. Legislative Intent

It is the intent of this local law to allow the Village of Menands to adopt a budget for the fiscal year commencing June 1, 2016 that requires a real property tax levy in excess of the “tax levy limit” as defined by General Municipal Law §3-c.

Section 2.  Authority

This local law is adopted pursuant to subdivision 5 of General Municipal Law §3-c, which expressly authorizes a local government’s governing body to override the property tax cap for the coming fiscal year by the adoption of a local law approved by a vote of sixty percent (60%) of said governing body.

Section 3.  Tax Levy Limit Override

The Board of Trustees of the Village of Menands, County of Albany, is hereby authorized to adopt a budget for the fiscal year commencing June 1, 2016 that requires a real property tax levy in excess of the amount otherwise prescribed in General Municipal Law §3-c.

Section 4.  Severability

If a court determines that any clause, sentence, paragraph, subdivision, or part of this local law or the application thereof to any person, firm or corporation, or circumstance is invalid or unconstitutional, the court’s order or judgment shall not affect, impair, or invalidate the remainder of this local law, but shall be confined in its operation to the clause, sentence, paragraph, subdivision, or part of this local law or in its application to the person, individual, firm or corporation or circumstance, directly involved in the controversy in which such judgment or order shall be rendered.

Section 5.  Effective Date

This local law shall take effect immediately upon filing with the Secretary of State.

The Treasurer requested that the board approved the following correction to the budget transfers from the 3/7/16 meeting due to an addition error – change the amount of the transfer from A.1990.0400 Contingent Account from $22,400 to $22,700.  Trustee Foley moved seconded by Trustee Harris the request from the Treasurer to correct the budget transfers from the meeting on 3/7/16.

The Clerk requested the Board declare the 2006 Chevrolet Tahoe (VIN # 1GNEC13Z86R150866) as surplus so the Village can advertise for its sale.

Trustee Harris, seconded by Trustee Nicoll offered a motion to declare the 2006 Chevrolet Tahoe as surplus.

The Mayor reported that NYS DOT would begin a painting project in October 2016.

She said that the Youth Easter Party held this past Saturday in the Village Hall was very successful.

The Mayor also said that a public information session would be held for residents by the NYS DOT to discuss plans for the Van Rensselaer Blvd.

At 6:10 P.M. Trustee Harris made a motion, seconded by Trustee Boulet to enter into Executive Session to discuss a legal issue.
