RESOLVED, by the Board of Trustees of the Village of Menands that Records and Disposition Schedule LGS-1, issued pursuant to Article 57-A of the Arts & Cultural Affairs Law, and continuing legal minimum retention periods for local government records in hereby adopted for use by all officers in legally disposing of valueless records listed therein.

FURTHER RESOLVED, that in accordance with Article 57-A:

a) Only those records will be disposed of that are described in Record Retention and Disposition Schedule LGS-1 after they have met the minimum periods described therein.
b) Only those records will be disposed of that do not have a sufficient administrative, fiscal, legal, or historical value of merit retention beyond established legal minimum periods.

• Every meeting of the public body must be open to the public.

• Executive Session is not open to the General Public.
• Videoconferencing must provide an opportunity for the public to attend, listen, observe, and participate in the meeting.
• Notice of the meeting and agenda will be available on the Village Website and posted in lobbies of Menands Police Department and Village Office.
• Public Comments:
o The public may only speak during the Public Comment period.
o Speakers must be recognized by the presiding officer.
o Speakers must limit their remarks to 3 minutes.
o All remarks must be addressed to the Board as a body and not to individual Board Members.

Mayor Marsh advised there are no changes to Village of Menands Procurement Policy offered the following resolution and moved its adoption:

PROCUREMENT POLICY FOR THE VILLAGE OF MENANDS

1. Every purchase to be made must be initially reviewed to determine whether it is a purchase contract or a public works contract. Once that determination is made, a good faith effort will be made to determine whether it is known or can reasonably be expected that the aggregate amount to be spent on the item of supply or service is not subject to competitive bidding, taking into account past purchases and the competitive amount to be spent in a year. The following items are not subject to competitive bidding pursuant to Section 103 of the General Municipal Law; purchase contracts under $20,000 and public works contracts under $35,000; emergency purchases; certain municipal hospital purchases; goods purchased from agencies for the blind or severely handicapped; goods purchased from correctional institutions; purchases under State and county contracts; and surplus and second-hand purchases from another governmental entity.

The decision that a purchase is not subject to competitive bidding will be documented in writing by the individual making the purchase. This documentation may include written or verbal quotes from vendors, a memo from the purchaser indicating how the decision was arrived at, a copy of the contract indicating the source which makes the item or service exempt, a memo from the purchaser detailing the circumstances which led to an emergency purchase, or any other written documentation that is appropriate.

2. All goods and services will be secured by the use of written requests for proposals, written quotations, verbal quotations, or any other method that assures that goods will be purchased at the lowest price and that favoritism will be avoided, except in the following circumstances: purchase contracts over $20,000 and public works contract over $35,000; goods purchased from agencies for the blind or severely handicapped pursuant to Section 175-b of the State Finance Law; goods purchased from correctional institutions pursuant to Section 186 of the Correction Law; purchases under State contracts pursuant to Section 104 of the General Municipal Law; purchases under county contacts pursuant to Section 103(3) of the General Municipal Law; or purchases pursuant to subdivision 6 of this policy:

A good-faith effort shall be made to obtain the required number of proposals or quotations. If the purchaser is unable to obtain the required number of proposals or quotations, the purchaser will document the attempt made at obtaining the proposals. In no event shall the failure to obtain the proposals be a bar to the procurement.

4. Documentation is required of each action taken in connection with each procurement.

5. Documentation and an explanation are required whenever a contract is awarded to other than the lowest responsible offer. This documentation will include an explanation of how the award will achieve savings or how the offer was not responsible. A determination that the offer is not responsible shall be made by the purchaser and may not be challenged under any circumstances.

6. Pursuant to General Municipal Law Section 104-b(2)(f), the procurement policy may contain circumstances when, or types of procurements for which, in the sole discretion of the governing body, the solicitation of alternative proposals or quotations will not be in the best interest of the municipality. In the following circumstances, it may not be in the best interests of the Village of Menands to solicit quotations or document the basis for not accepting the lowest bid:

a. Professional services or services requiring special or technical skill, training, or expertise. The individual or company must be chosen based on accountability, reliability, responsibility, skill, education and training, judgment, integrity, and moral worth. These qualifications are not necessarily found in the individual or company that offers the lowest price, and the nature of these services are such that they do not readily lend themselves to competitive procurement procedures.
In determining whether a service fits into this category, the Board of Trustees shall take into consideration the following guidelines: (a) whether the services are subject to State licensing or testing requirements; (b) whether substantial formal education or training is a necessary prerequisite to the performance of the services; and (c) whether the services require a personal relationship between the individual and municipal officials. Professional or technical services shall include but not be limited to the following: services of an attorney; services of a physician; technical services of an engineer engaged to prepare plans, maps, and estimates; securing insurance coverage and/or services of an insurance broker; services of a certified public accountant; investment management services; printing services involving extensive writing, editing or artwork; management of the municipally owned property; and computer software or programming services for customized programs, or services involved in substantial modification and customizing of pre-packaged software.
b. Emergency purchases pursuant to Section 103(4) of the General Municipal Law. Due to the nature of this exception, these goods or services must be purchased immediately, and a delay in order to seek alternate proposals may threaten the life, health, safety, or welfare of the residents. This section does not preclude alternate proposals if time permits.
c. Purchases of surplus and second-hand goods from any source. If alternate proposals are required, the Village is precluded from purchasing surplus and second-hand goods at auctions or through specific advertised sources where the best prices are usually obtained. It is also difficult to try to compare prices of used goods, and a lower price may indicate an older product.
d. Goods or services under $1,000. The time and documentation required to purchase through this policy may be more costly than the item itself and would, therefore, not be in the best interests of the taxpayer. In addition, it is not likely that such de minimis contracts would be awarded based on favoritism.

7. To ensure that this policy and budgets are being implemented, Village Department heads are required to meet with the Village treasurer at least quarterly.

8. The Village Board hereby adopts, by resolution, and pursuant to GML 103(5) that for reasons of efficiency and economy, there is a need for standardization, and upon adoption of a resolution for a particular type or kind of equipment, material, or supplies, maybe not necessarily be awarded to the lowest responsible bidder.

  1. The Mayor advised the Trustees that the 100th Centennial Community Night and Picnic is scheduled for Wednesday, August 21st, 2024, 5:00 P.M. to 8:00 P.M. entertainment will be the East Berne Band. (rain date Thursday, August 22nd, 2024).
  2. The advised that there is a company that can mill the sidewalks along Brookside and Menand Road to eliminate trip hazards. Discussion followed.
  3. The Village of Menands has received $19,000.00 from Albany County to make improvements to Polk-Switzer Park.
  4. Would like to adopt a policy that employees could live in abutting counties. Discussion followed.
  5. The water bills where sent out today.
  6. At the July 15, 2024, the Board Meeting the Zoning Law Changes and 51 Irving Place Special Use Permit will be approved.
  7. Before the start of the July 15, 2024, Board Meeting there will be an update on the South End Water/Sewer Project.
  8. The Senior Picnic was a success.
  9. Concerts in the Park start July 8, 2024, and the Food Truck Festival starts July 9, 2024, and Community Night will be August 21, 2024.
  10. The Village has received a quote to clean the Pavilion Hood and the kitchen hood at the Firehouse at cost of $1225.00 for both.
  11. The Moodies report shows the Village’s bond rating is AA3.
  12. The fiscal year has ended June 30, 2024, and there was a surplus on $845,768.00. The Village is still waiting for a disbursement from EFC and the CHIPS monies.
  13. There will be a wreath Ceramony at Albany Rural Cemetery in August to celebrate Louis Menand’s Birthday. Discussion followed.

Trustee’s Report:

Harbour:
1. Due to construction at Menands School the Board of Education meeting on July 8, 2024, will be held in the Village Hall.
2. The Park Program will start on Monday July 8, 2024.

Harris:
1. Instead of buying fireworks this 4th of July consider donating to the Animal Shelter, because of the way fireworks effect animals.

Kalogridis:
1. Park Lane Park Hill has a lot of trash near the pools.
2. Asked about the Paving Plan for this year. Discussion followed.

Lane:
1. Gave an update on the little River Grant.

General Comments:

Resident Chuck Price asked about the outdoor seating at Fusion Recovery. The Mayor advised that Fusion Recovery is working on a plan for the outdoor seating.

Resident Cindy Price asked about the outdoor seating at the dispensary at 90 Broadway. Discussion followed.

Resident Mike MacKay asked when Bill Smith’s term is up. Discussion followed.

Resident Susan Harris
1. Suggested that the Village should consider doing something for the grandson of Louis Menand.
2. Suggested as part of the climate smart community the Village should consider a community garden. The Federal Government is offering money for climate projects.
3. The Village should try to involve the more youth in climate projects.

Resident Steve Boulet
1. There are scrubs and trees blocking the sidewalk on Menand Road.
2. Thanked the Police for enforcing the parking on Menand Road.

Resident Chuck Price
1. On Broadway near 444 Broadway there is a lot of high grass.
